Our client purchased a diamond necklace after seeing it advertised online. When the necklace arrived, she believed it did not match what had been represented in the advertisement. She returned the necklace expecting a refund, but according to her allegations, the business refused and instead directed her toward additional purchases while retaining her money.

Our Approach

Our attorneys investigated the transaction, reviewed the communications between the parties, and pursued claims under the Texas Deceptive Trade Practices Act (DTPA), along with other consumer-related causes of action.

The defendant denied wrongdoing, maintaining that its policies had been disclosed and that no legal violation had occurred. Rather than settling the dispute, the case proceeded through litigation and ultimately to a jury trial.

The Outcome

After hearing the evidence, the jury returned a verdict in favor of our client.

The jury awarded:

• $8,218.75 in actual damages
• $1,000.00 in mental anguish damages

Following the verdict, Sanchez Law Firm sought recovery of attorney's fees and other relief available under Texas law.
